I emailed death threats...?

i emailed death threats back in July and they are just now issuing a 2nd degree felony warrent on me. this was also prior to emails being included in the 2nd degree felony catagory. that didnt pass until oct 1st. i live in florida. can someone tell me if i can use the post ex facto to my advantage? and the fact it was so long ago??
